AMERICA’S MOBILE TERMS & CONDITIONS OF SERVICE
Terms and Conditions – High-Speed Wireless LTE Internet Service by America’s Mobile
Please carefully review these terms and conditions (“Terms”) before subscribing to our High-Speed Wireless LTE Internet service (“Service”) at America’s Mobile (“Provider” or “We”). These Terms form a legally binding agreement between you (“Subscriber” or “You”) and America’s Mobile. By subscribing to the Service, you acknowledge that you have read, comprehended, and consent to be bound by these Terms. If you do not agree with these Terms, you may not utilize the Service.
Service Description
Our High-Speed Wireless LTE Internet Service offers high-speed Internet access to Subscribers in multiple locations.
The Service includes an unlimited data plan, which is subject to a fair use policy designed to ensure the best performance and network quality for all Subscribers.
The Service is prepaid, with monthly fees payable on the 1st of each month. New activations will be prorated accordingly.
Fair Use Policy
Our fair use policy aims to prevent excessive and abusive use of the network and maintain a high-quality internet experience for all Subscribers.
The policy allows for reasonable and non-excessive usage of the unlimited data plan, with excessive usage determined based on factors like network capacity, usage patterns, and its impact on other Subscribers.
The Provider reserves the right to monitor network usage and take necessary actions, such as throttling or suspending the Service, if the Subscriber’s usage is considered excessive and detrimental to overall network performance.
Subscriber Responsibilities
The Subscriber agrees to use the Service in compliance with all applicable laws and regulations.
The Subscriber shall not use the Service for any unlawful, harmful, or unauthorized activities, including but not limited to:
- Violating copyright or intellectual property rights.
- Engaging in illegal file-sharing or distribution of copyrighted materials.
- Engaging in any activity that may harm the network or other Subscribers’ experience.
- Attempting unauthorized access to any computer system or network.
The Subscriber is responsible for all activities carried out through their account and must keep their account credentials confidential. Any unauthorized use of the Service must be reported to the Provider immediately.
Service Availability
Service availability depends on the Provider’s network coverage and technical feasibility in the Subscriber’s area. We do not guarantee uninterrupted or error-free access to the Service.
The Subscriber acknowledges that factors beyond the Provider’s control, including network congestion, weather conditions, and equipment limitations, may affect the Service.
Service Fees and Billing
The Subscriber is responsible for paying the fees associated with the Service as outlined in the agreed-upon pricing plan, with monthly fees due on the 1st of each month.
New activations will be prorated based on the activation date.
The Provider reserves the right to modify the pricing and fee structure with prior notice to the Subscriber.
The Subscriber is responsible for all charges related to the Service, including applicable taxes and fees.
Billing cycles and payment methods will be communicated to the Subscriber by the Provider.
Router Return
If the Provider supplies the router for the Service, the Subscriber agrees to return the router to the Provider upon canceling the Service.
The router must be returned in good working condition within 30 days of Service cancellation.
Failure to return the router within the specified timeframe may result in the Subscriber being charged for the cost of the router.
Termination
The Subscriber may terminate the Service at any time by providing written notice to the Provider.
The Provider may terminate the Service if the Subscriber breaches these Terms or engages in any activity that violates the fair use policy or applicable laws.
Upon termination, the Subscriber shall cease using the Service, and any outstanding fees must be paid in full.
If the Provider has provided a router to the Subscriber, as mentioned in Section 6, the Subscriber must return the router in good working condition within 30 days of Service cancellation.
In the event of non-return or damage to the router beyond normal wear and tear, the Subscriber may be charged the replacement cost of the router.
The Provider reserves the right to retain any prepaid fees or deposits to cover any outstanding charges, including but not limited to the router replacement cost, in the event of non-compliance with the return policy.
Limitation of Liability
The Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Service.
The Provider’s liability for any claim related to the Service shall be limited to the amount paid by the Subscriber for the Service during the three (3) months preceding the claim.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where America’s Favorite Mobile is located.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in the aforementioned jurisdiction.
Amendments
America’s Favorite Mobile reserves the right to modify or amend these Terms at any time, with prior notice to the Subscriber.
Amendments to these Terms shall be communicated to the Subscriber through reasonable means, such as email or website notifications.
Continued use of the Service after receiving notice of the amended Terms constitutes acceptance of the modified Terms.
By subscribing to America’s Favorite Mobile’s High-Speed Wireless LTE Internet Service, the Subscriber acknowledges and agrees to be bound by these Terms and Conditions.
